The firm of David L. Fulton, CPA offers tax planning, income tax return preparation, interaction with the taxing authorities and general business advice. Our approach is unique. We view the federal income tax laws as starting with the Internal Revenue Code. This is a set of laws passed by the Congress of the United States and made effective with the signature of the President.

Often these laws are ambiguous and the Federal Court system is where the ambiguity is resolved. The problem is that there are several different court systems within the Federal Court system. There is Tax Court, Federal Court, Federal Appeals Court, based on which district the case was heard in, and finally the United States Supreme Court. The challenge is, when one district might rule a certain way and another district rules differently with a similar type of case, which one to follow.

Finally, when you view the Internal Revenue Code as a "social engineering tool" you start to see patterns of logic. Most practitioners go to the Internal Revenue Service Regulations as if they were the law.

Recently, a Congressional committee held hearings on the federal tax deduction for contributions to qualified charitable organizations.
The lawmakers heard from a variety of speakers, individuals from community service, educational and religious groups.
All of the speakers told Congress that the tax deduction for charitable giving encourages individuals to make donations.
Many of the lawmakers agreed, noting that the deduction is charitable giving is one of the most widely used.
As the year draws to a close, it is a good time to examine how charitable giving can impact your year-end tax planning and review the often complex rules making sure your donation is tax-deductible.
